These are the promises we make to each other when you use Daylie. We cut the hard words and wrote down only what is needed. How we handle personal information is written separately in the Privacy Policy.
Article 1 (Purpose and Application)
These Terms set the conditions for using the Daylie app and website (the “Service”) provided by Digioptics, LLC (the “Operator”). If you use the Service, you are considered to have agreed to these Terms.
Article 2 (What the Service Is)
Daylie is a service through which a family knows about a parent's day from the photos the parent takes.
The parent's phone — A simple photo app where the camera turns on as soon as you open it. Parents do not log in; they are connected just once, with a QR code or a one-time connection code that the family shows them.
The family's (adult child's) phone — See the parent's photos along with the time, the place name, and the photo memo; see the places they went; leave a short message; and send their own photos to the parent.
Notifications — We notify the family when a photo arrives, and once in the evening with the news of the day's photos. The parent's phone is notified only of photos and messages the family sent.
The basic features are free. Paid plans that keep photos longer and let more family members view them are governed by Article 9.
Article 3 (Accounts)
A family account is created by signing in with a Google or Apple account. You must manage your own account, and we recommend that you not share it with other people.
The parent's phone uses an anonymous session, with no account. The records from that phone belong to the family account it is connected to.
People under 14 years of age may not use the Service.
You can delete your account yourself at any time in the app, under Settings → Delete account (설정 → 계정 삭제). We will also delete it if you ask at the email address in Article 13. Deleting it deletes your photos and records as well, and this cannot be undone.
Article 4 (User Content)
For the photos, short messages, names, and the like that you put into the app (the “User Content”), all rights belong to you. The Operator does not take them as its own.
However, to the extent necessary to run the Service, the Operator may store User Content, show it to the connected family, change its size (as with thumbnails), create photo memos, and delete it once the retention period has passed. The providers that help with this work (such as Firebase) are listed in Section 5 of the Privacy Policy. This scope is limited to providing the Service; it is not used for advertising, public disclosure, or sale to other companies. The Operator does not train AI models on User Content. If you delete your account or your photos, this scope ends with them.
Article 5 (Family Sharing and the Parent's Consent)
Daylie is a service in which a family sees a parent's photos. For that reason, you must observe the following.
When the parent's phone is connected, the app asks the parent, “Shall we show your family how your day went?”, and photos are delivered only after the parent taps consent themselves. Do not tap this consent on their behalf.
If the parent is not in a condition to consent on their own, the family member who connects the phone must have the authority to do so under the law (as a legal representative, a guardian, and so on), and that responsibility lies with the family member who connected it.
If the parent says they want to stop, disconnect right away. You can disconnect and delete the records in the app, under Settings → Delete parent (설정 → 부모님 삭제).
If another person appears in a photo, responsibility for the family seeing that person's photo lies with whoever uploaded it.
Article 6 (Prohibited Uses)
Using the Service to secretly watch or track the location of anyone other than yourself or a family member who has consented
Intercepting another person's account or connection code, or using it without permission
Posting content that breaks the law, content that harasses or insults others, or obscene content
Scraping the Service with automated tools, putting a load on the servers, or trying to get around security measures
Copying the Service to build another service, or reverse-engineering the code to use it commercially
If such use is confirmed, the Operator may restrict or suspend that account's use of the Service. In serious cases we may not be able to give notice in advance; in that case we will tell you the reason afterward.
Article 7 (Limits of the AI Photo Memo)
The one-sentence description attached to each photo is written automatically by AI looking at the photo. It can be wrong. Place names and addresses may also differ from the real ones.
Daylie is not a medical device and is not a medical service. A photo memo, or the flow of the photos, does not tell you about health status, cognitive function, or the presence of illness, and you must not interpret or use it for that purpose. If you have concerns about health, consult a medical professional. Also, do not use it as a way to report an emergency. Photos not arriving does not mean that someone is safe, nor that they are in danger.
Article 8 (Changes to and Termination of the Service)
The Operator may change the content and the screens of the Service in order to make them better.
The Service may stop temporarily because of maintenance, failures, network conditions, and the like. We give notice in advance of maintenance we can know about ahead of time.
If the Service is shut down entirely, we will give notice in the app and on this website at least 30 days in advance, together with how and by when you can download your photos.
You can end your use at any time by deleting the app or deleting your account.
Article 9 (Paid Plans and Subscriptions)
Plans. The Free plan is free of charge. Plus and Family are paid plans that, for one parent, keep photos longer and let more family members view them; what each plan includes and its price are shown on the plan screen in the app. Prices follow the country and currency of the store you use (Apple App Store or Google Play).
Payment and automatic renewal. Paid plans are billed as monthly subscriptions through the Apple App Store or Google Play. Unless you cancel, a subscription renews automatically every month at the same price, and the renewal is charged to your store account when the current period ends (on Apple, within 24 hours before it ends). The store manages your payment method and receipts; the Operator does not receive payment details.
Cancelling. You can cancel at any time in your phone's store subscription settings (iPhone: Settings → your Apple Account → Subscriptions; Android: Google Play → Payments & subscriptions → Subscriptions). After cancelling you keep the plan until the end of the period you already paid for, and then return to the Free plan. Deleting the app alone does not cancel a subscription.
Withdrawal and refunds. Under Korea's Act on the Consumer Protection in Electronic Commerce you may withdraw from the purchase within 7 days of payment. Once a paid plan has started being provided, withdrawal may be limited to the extent the law allows; even then, we refund any period during which you could not use the Service for reasons the Operator is responsible for. Because you paid through a store, refunds go through Apple's or Google's refund process; if that is difficult, write to the email address in Article 13 and we will help. Where the consumer-protection law of your own country gives you more rights, those rights are not affected.
When a plan ends. When a paid plan ends and you return to the Free plan, photos older than the Free plan's keeping period may be deleted. We tell you inside the app before that happens.
Price changes. If a price goes up, we give at least 30 days' notice in the app and on this page, and the new price applies only if you agree to it through the store's own process.
Article 10 (Disclaimer of Warranties and Limitation of Liability)
The Service is provided “as is,” and we do not warrant that photos will always be delivered without exception or that notifications will always arrive on time.
The Operator is liable, to the extent set by law, for damage caused by its own intent or negligence. The Operator is not liable for damage arising from causes that are not its responsibility, such as natural disasters, failures at telecom carriers or cloud providers, conditions on the user's phone, or data the user deleted themselves.
To the extent permitted by law, the Operator's liability for damages is limited to ordinary damages and does not extend to indirect, special, or consequential damages. If you use a paid plan, unless the law provides otherwise, the Operator's liability is limited to the amount you paid for that plan in the three months before the problem arose.
Photos are precious, so we recommend keeping important photos separately on your phone or somewhere else.
Article 11 (Changes to These Terms)
If these Terms change, we will post the changed content and the effective date on this page. For changes that are unfavorable to users, we will give separate notice inside the app at least 30 days before the effective date. If you keep using the Service after that notice, you are considered to have agreed to the changed Terms. If you do not agree, you can end your use by deleting your account.
Article 12 (Governing Law and Dispute Resolution)
The law of the Republic of Korea applies to these Terms and to use of the Service. If a dispute arises, please first tell us at the contact below, and we will try to resolve it by talking with each other. If it is not resolved, a suit may be filed with the court set by the Civil Procedure Act (민사소송법). Consumers may also apply for mediation to the Korea Consumer Agency or the Electronic Document and Transaction Dispute Mediation Committee. Where the consumer-protection law of your own country gives you rights that cannot be waived, those rights are not affected.
